What the Authority decided

On 6 July 2018, the Authority decided to cancel the registration of registered migration agent Yi Sun (MARN: 1068900). As a result of an investigation into 15 complaints, the Authority was satisfied that the Agent had breached clauses 2.1, 2.4, 2.8, 2.9, 2.9A, 3.4, 5.1, 5.2, 5.5, 6.1, 7.2 and 2.23 of the Code of Conduct. The Authority found the Agent failed to advise a client of a visa application outcome, and entered into an arrangement which enabled the provision of a fraudulent document. The Agent failed to keep clients informed of the progress of applications, did not act on instructions from multiple clients, provided multiple fraudulent documents to the Department of Home Affairs (the Department) and provided false information to clients. The Agent failed to declare her immigration assistance or representation on numerous applications. The Agent failed to enter into an Agreement of Services and Fees with multiple clients and did not maintain proper client records. The Agent acted without authority to bind a sponsor. The Agent knowingly lodged nomination applicants for non-genuine businesses to the Department and did not take appropriate steps to verify the genuineness of businesses. In response to the complaints, the Agent provided incomplete and misleading information to the Authority. As a result, the Authority also found that the Agent was not a person of integrity and not a fit and proper person to give immigration assistance. What this decision does not mean
