What the Authority decided

On 8 July 2019, the Office of the Migration Agents Registration Authority (the Authority) decided to cancel the registration of Mr Qi Wang (MARN 1465236) following an investigation into two complaints in relation to the Agent's conduct. The Authority was satisfied that the Agent had breached clauses 2.1, 2.4, 2.8, 2.9, 2.9A, 2.17, 2.23, 5.1, 5.5, 6.1, 6.1A, 7.4, 9.1 and 9.3 of the Code of Conduct for registered migration agents, and was not a person of integrity or not a fit and proper person to give immigration assistance.

The Authority found that the Agent had demonstrated a blatant disregard for the law and the migration regulatory scheme by repeatedly providing false and misleading information to the Authority, including in a statutory declaration, in order to conceal his conduct. The Agent was found to have charged visa applicant clients excessive fees, including for services associated with nomination applications, and in one case, obtained a fee from a client to be provided to an employer as a payment for nominated position. The Agent also breached the Migration Act 1958 (the Act) by not declaring his involvement in a nomination and visa application to the Department, lodging a nomination application in association with a client’s visa application without the sponsor’s knowledge or permission, and creating false documents to mislead his clients as to the progress of their applications, and conceal his own conduct.

What a cancellation means if this was your agent

What this decision does not mean
