What the Authority decided

On 6 October 2016, the Authority decided to cancel the Agent’s registration as a migration agent. The decision was made following a decision by the Supreme Court of Tasmania to remove the Agent’s name from the Roll of Legal Practitioners in Tasmania on the ground of professional misconduct. The Supreme Court of Tasmania found that the Agent, inter alia: -Breached her fiduciary duty on a number of occasions; -Failed to seek instructions, adequately advise and act in the best interests of the client; -Was knowingly in a position of conflict of interest while acting for her client; -Grossly overcharged her client;- Delayed a response to, and obstructed reasonable requests from, the Public Trustee and failed to fully account to the Public Trustee with regard to the financial matters of her client; -Knowingly misled the Guardianship and Administration Board of Tasmania (GAB) regarding the financial affairs of her client; -Attempted to mislead the Legal Practitioner’s Board of Tasmania (LPBT) during its investigations by making a false statutory declaration and producing files notes to the LPBT that purported to be contemporaneous file notes but were not; -Charged her client for costs and disbursements in respect of two visa applications that were gross and excessive amounts for the work done, particularly in light of the fact that the Agent knew, or should have known, that the second visa application had no prospect of success; -Failed to handle trust money in an appropriate manner; -Made threats against her client; -Disclosed and/or instigated the disclosure of confidential medical information about her client, without consent, to her client’s employer, in an attempt to damage her client’s future employment prospects; -Attempted to mislead the LPBT in the course of its investigations by presenting fabricated documentation in order to create the impression that the Agent had complied with her obligations to her client; -Attempted to mislead the Court that her firm was closed and not operating during a period when in fact this firm was open and operating in an attempt to resist an order being granted that she be suspended from practice. Based on the findings and decision of the Supreme Court, the Authority was satisfied that the Agent was not a person of integrity and was otherwise not fit and proper to give immigration assistance. Taking into account the seriousness of the Agent’s conduct, and in the interests of consumer protection, the Authority considered that a cancellation decision was appropriate in the circumstances.
