A skills assessment can decide whether an occupation can be claimed for a points-tested skilled visa, and it often takes longer than people expect. The practical problem is that there is no single assessing authority. The authority, documents, fees and processing times depend on the occupation, and the assessment is a separate process from the visa application.

A skills assessment is a decision by an approved assessing authority about whether a person's qualifications and employment are comparable to the standard expected for a nominated occupation in Australia. It is not the visa application itself, and it is not made by the Department of Home Affairs.

For many skilled migration pathways, the occupation on the relevant occupation list is tied to a specific assessing authority. That authority checks evidence against its own rules, not the visa criteria as a whole. A positive assessment can be required before an Expression of Interest is lodged, before an invitation is accepted, or before a visa application is lodged, depending on the pathway and occupation.

The assessment can also be used for other purposes, such as employer-sponsored processes, registration pathways, or state and territory nomination requirements. Even where the occupation title looks familiar, the authority may assess a narrower role, a different ANZSCO unit group, or a different skill level.

Different occupations are assessed by different bodies. Engineers are commonly assessed by Engineers Australia. Accountants may deal with CPA Australia, Chartered Accountants Australia and New Zealand, or the Institute of Public Accountants. Trade occupations are often assessed through Trades Recognition Australia programs, while many general professional occupations go through VETASSESS.

Health occupations are often assessed by profession-specific bodies. Nurses, doctors, teachers, social workers, psychologists, architects and many others each have their own authority, standards and evidence rules. Some occupations also involve registration or licensing bodies that are separate again from the migration skills assessment.

This is why two people applying under "skilled migration" can have completely different document lists, fees and wait times. One authority may rely heavily on formal qualifications. Another may focus on post-qualification employment, practical tasks, licensing, English test results or a technical interview.

The authority is not chosen by preference. It is usually set by the occupation being claimed. If a person is still working out which occupation code matches their work history, that is often where a registered migration agent or Australian legal practitioner becomes involved, because matching duties to an occupation for migration purposes is immigration assistance under s280 of the Migration Act 1958 if done in Australia by someone unregistered.

Processing times vary because the authorities are doing more than checking that a form is complete. They may verify qualifications, compare overseas study to Australian standards, assess employment references against task lists, review payslips or tax records, and ask for further information if something is unclear.

A delay often starts with document quality. Employment letters that do not describe duties clearly, certificates that do not match passport details, missing translations, incomplete academic transcripts or inconsistent dates can all trigger requests for more information. Each request stops the file moving until a response is uploaded and reviewed.

Some authorities have staged processes. A trade applicant, for example, may go through a documentary assessment and then a practical assessment or technical interview. Health and regulated professions may involve separate registration checks, English evidence or identity verification. Those extra steps add time and cost.

Most assessing authorities look at three broad areas: identity, qualifications and employment. Identity documents usually include a passport and, where relevant, change of name evidence. Qualifications can include award certificates, full transcripts, course syllabi and evidence of the institution.

Employment evidence is often the part that causes the most trouble. Authorities commonly ask for reference letters on company letterhead, signed by an authorised person, with job title, exact dates, hours worked, salary and a description of duties. They may also ask for supporting material such as contracts, payslips, tax records, social insurance records or business registration documents.

Some authorities want employment only after a certain point, such as after a qualification was completed or after professional membership was obtained. Others apply deductions, meaning they may recognise an occupation as suitable but count only some work as "skilled employment" for migration purposes. That is one reason a positive assessment does not always mean all claimed years of experience will be accepted for points.

Documents from outside Australia often need certified copies or translations by an approved translator. False or altered documents are a serious risk. Migration law treats bogus documents and false or misleading information very seriously, including under s234 and s245AR of the Migration Act 1958, and Public Interest Criterion 4020 can affect visa outcomes.

The visa application is decided by the Department of Home Affairs. The skills assessment is decided by the assessing authority. Each body can ask for different documents, and dates matter. A document accepted by the assessing authority may still need to be uploaded again for the visa if the Department asks for it.

Validity periods also matter. Many skills assessments have an expiry date or are treated as valid only for a certain period. Some remain usable for migration only while an underlying registration, membership or passport stays current. Because the assessment and visa are separate, timing needs to be checked carefully against the rules that apply at the time of lodgement.

This separation is also why fees are separate. The assessing authority charges its own assessment fee. The visa application charge is a different charge paid to the Department. Other costs can include English tests, medicals, police certificates, translations, certifications and, where a professional is engaged, service fees. Assessment fees vary widely between authorities. A straightforward paper-based professional assessment may cost a few hundred dollars, while trade assessments, practical assessments and regulated profession pathways can be much higher. Priority processing, reassessment, review applications and document replacement can create extra charges.

Review rights also vary. Some authorities offer an internal review or appeal process against an unfavourable outcome, often with a strict deadline and a separate fee. Others allow a fresh application instead. The review body, evidence rules and timeframes depend on the authority, not on a single migration-wide system.

If a registered migration agent or Australian legal practitioner is engaged to help with the process, there are consumer protection rules. Under the Migration Agents Code of Conduct 2021, a consumer guide must be given first, s38, the services and fees must be set out in a written agreement, s42 and s46, and invoices and receipts must be provided, s49. Agents must not guarantee outcomes, s26, and advertising must include the agent's MARN, s25.

Where a representative is appointed, the appointment is usually recorded with Form 956 for visa matters, under s312A of the Migration Act 1958. For skills assessments, the authority may also have its own nomination or authority form for dealing with an agent. Keeping copies of all submissions and receipts matters, and under the Code, registered migration agents must retain records for seven years, s56.
