What the Authority decided
On 18 October 2019, the Authority decided to cancel the registration of Registered Migration Agent Mr Tuan Vu TRAN (MARN: 1280233). As a result of an investigation into one complaint the Authority was satisfied that the Agent breached clauses 2.1, 2.3, 2.9, 2.9A, 2.19, 2.23, 6.1, 6.1A, 6.2, 6.3 and 9.3 of the Code of Conduct for Registered Migration Agents (the Code).
The Authority found that
- the Agent was complicit in fraudulent conduct in the creation of companies that the Agent knew, or should have reasonably known, were not lawfully operating in Australia but were registered for the purposes of obtaining immigration outcomes for his clients for which they were not genuinely entitled.
- the Agent submitted applications containing false and misleading documentation and information, to the Department, showing a disregard for the law and his professional obligations as a registered migration agent.

- the Agent failed to maintain appropriate record keeping and record management practices which has prevented him from adequately responding to the Authority.
- the Agent mislead and deceived the Authority, by providing false and misleading information and further dishonest statements, in relation to the matter at hand and in turn failed to maintain the integrity and repute of the migration advice profession.
It was also determined that the Agent was not a person of integrity and not a fit and proper person to give immigration assistance.

What this decision does not mean

Finding someone else
