如何在大約九十秒內查核移民代理是否真實

有一項查核可以排除這個市場中大部分風險，它是免費的，約花九十秒，而且幾乎沒有人在交錢前會先做。

該查核#

1. 詢問此人的 MARN - Migration Agents Registration Number。它有七位數，例如 0532463。每位註冊代理都有一個，並且必須在其廣告上顯示。
2. 前往 OMARA（移民代理註冊管理局）移民代理登記冊。這是政府自己的登記冊，而且是公開的。
3. 搜尋該號碼，或該人的姓名。
4. 閱讀該紀錄。確認它是 目前以及姓名與你正在交談的人相符，且沒有你未被告知的紀律處分紀錄。

就是這樣。如果這個號碼查不到目前有效的註冊，就停止。

登記資料會告訴你什麼#

目前的紀錄會給你：

• 該代理的 名稱 和 MARN（移民代理註冊號）
• 註冊是否 目前, 以及何時到期
• 他們的 營業地址 以及通知主管機關的聯絡資料
• 任何 紀律處分決定 - 警告、停牌、禁業

Registration is annual. It lapses. An agent whose registration has expired is not permitted to give immigration assistance, and an agent whose registration was cancelled is emphatically not. This is why checking once at the start is not quite enough for a two-year matter, and why re-checking before each payment is a reasonable habit.

另一種合法的資格：律師#

自 22 March 2021，持有不受限制執業證書的澳洲法律執業者已不再向 OMARA（移民代理註冊管理局）註冊。他們改由其所在州或領地的法律服務專員監管。因此，律師不會有 MARN（移民代理註冊號碼），沒有 MARN 並不是危險訊號 如果 他們確實是執業律師。

四件應該讓你停止的事#

1. 他們不會給你一個號碼#

如果一位代理人迴避這個問題，改給你公司號碼，說「we work with a registered agent」卻不說出對方姓名，或傳來截圖而不是一個你可以自己查詢的號碼，那他其實已經回答你了。

2. 號碼與該人不符#

This one is common and it is the reason to search the register yourself rather than accept a screenshot. Some operators quote a real MARN belonging to a real agent who is not involved. Under section 283 of the Migration Act it is an offence to falsely represent yourself as a registered agent.

3. 有註冊，但實際工作是由其他人完成#

由未註冊人士實際處理工作，而註冊代理的號碼只是放在信頭上，對雙方以及對你來說都是嚴重問題：這表示處理你案件的人不對任何監管機構負責，而且不能合法就此收費。

Every provider on VisaBid is checked against the OMARA register or their state legal register before they can quote, and their registration number is printed beside their name on every page they appear on. Registrations are re-checked, and an agent whose registration lapses cannot quote and cannot continue an existing engagement.

If they are giving immigration assistance in relation to an Australian visa and they are not registered with OMARA or an Australian legal practitioner, then charging you a fee is an offence under section 281 of the Migration Act - and that offence reaches offshore conduct in ways many overseas operators do not expect. Registration is not limited to people in Australia: agents in India, the Philippines, the UK and elsewhere hold MARNs. Ask for the number.

Registration is renewed annually and most renewals are routine. What matters is that it is renewed. If it lapses, your agent cannot lawfully continue to give you immigration assistance, and you would need to be transferred to someone who can. Ask when their registration expires before you engage them - it is a fair question and any competent agent will answer it without blinking.
