What you are entitled to from a migration agent

This page summarises rights that exist in law regardless of anything VisaBid does. The official consumer guide is published by OMARA and your agent must give it to you before they give you any immigration assistance. If nobody has given you one, that is itself a breach.
Before any work starts
- You must be given the consumer guide (s38).
- You must have a written service agreement, கையெழுத்திடப்பட்டு, செய்ய வேண்டிய பணியை உள்ளடக்கி முகவர் செயல்பட அனுமதிப்பது (s42).
- The agent must not take any money from you before that agreement is in place (s51).
கட்டணங்கள் பற்றி
- Fees must be a fixed fee or an hourly rate with an estimate of hours, and must be fair and reasonable (s46).
- முதலில் எழுத்துப்பூர்வமாக ஒப்புக்கொள்ளாமல் estimate ஐ மீறி உங்களிடம் கட்டணம் வசூலிக்க முடியாது.
- You must get an இதற்கு முன் உருப்படி வாரியான விலைப்பட்டியல் being charged and a ரசீது பிறகு paying (s49).

What an agent must never do
- Say they can obtain a particular decision, or guarantee a visa (s26).
- Home Affairs Department உடனோ அல்லது OMARA (குடியேற்ற முகவர் பதிவு ஒழுங்குமுறை அமைப்பு) உடனோ தொடர்பு இருப்பதாக உணர்த்துதல் - இதில் "Government registered" அல்லது "MARA approved" போன்ற சொற்றொடர்களும் அடங்கும் (s26).
- Make false or misleading statements about your prospects or about their own qualifications.
- Advertise without their registration number (s25).
- Disclose your personal information to a third party without your written consent (s35).
Your file and your documents
- உங்கள் முகவர் உங்கள் விவகாரத்திற்கான கோப்பை இத்தனை காலம் வைத்திருக்க வேண்டும் ஏழு ஆண்டுகள் after the last action on it (s56).
- You can ask in writing for the documents you own, and they must be returned within 14 நாட்கள் (s54). VisaBid இல் நீங்கள் முழு கோப்பையும் எப்போது வேண்டுமானாலும் நீங்களே export செய்யலாம்.
புகார் செய்தல்
- A registered migration agent: complain to OMARA.
- ஒரு lawyer: அவர்களின் state அல்லது territory-யில் உள்ள legal services commissioner-க்கு புகார் செய்யவும்.
- Someone charging you who is registered as neither: that is a criminal offence under s280 of the Migration Act. Report it to the Australian Border Force.
